So I misunderstood this for a while. I'll explain after the great news.
I assumed the law would codify gay marriage, a symbolic but ultimately useless law if the Supreme Court finds it unConstitutional since there on gay marriage in 1800.
BUT, it was cleverly designed to pass the test of this Supreme Court. The law simply strikes the Defense of Marriage Act - even though it is no longer followed due a Supreme Court ruling from the olden days.
AND each state must recognize a marriage performed in another state. So, if Texas outlaws gay marriage, they still have to recognize a couple that traveled to New Mexico to get married. And treat as married for benefits, next of kin, etc.
Awesome news. Also bodes well for potential bipartisanship in the new Congress.
